WineView Privacy Policy

WineView Inc., a Delaware corporation with its principal place of business at 2200 Wilson Blvd Suite 102 PMB 8 ("WineView," "we," "us," or "our"), respects your privacy and is committed to protecting your personal information. This Privacy Policy describes how we collect, use, disclose, and safeguard your information when you access or use our online platform (the "Platform"), including our website, web application, Business Dashboard, Member Portal, and related services (collectively, the "Services"). The Services are designed to assist Merchants (such as wineries, wine bars, retail bottle shops, and restaurants) in managing subscription clubs, events, rewards, and inventory, and to enable Customers/Members (end-users) to subscribe to and manage club memberships.

This Privacy Policy applies to all use of our websites (e.g., https://www.wineview.com) and mobile applications (if applicable). By using the Platform or Services, you consent to the practices described in this Privacy Policy. If you do not agree, please do not use the Platform or Services. This Policy applies to all users, including Merchants and Customers/Members, and is incorporated into our Terms of Service.

We may amend this Privacy Policy from time to time. We will provide fair notice (e.g., via email or posting on the Platform) before material changes take effect, giving you the opportunity to review the revised policy before continuing to use the Services. We will only use personal data in accordance with the Privacy Policy under which it was collected, unless we specifically obtain your consent for a new purpose.

Data Controller

WineView is the data controller for the processing of all personal data concerning users of the Platform. This Privacy Policy covers our processing of personal data received when you register, access the Platform, and use our Services. We process your personal data to manage user relations, including account management and providing access to the Platform.

We will process your personal data in compliance with applicable United States laws, including the General Data Protection Regulation (GDPR) for users in the EU/UK, the California Consumer Privacy Act (CCPA/CPRA), and other state and local privacy regulations.

Processing is based on your freely given consent (provided when signing up or using the Services), fulfillment of contractual obligations (e.g., delivering the Platform), and our legitimate interests (e.g., improving services).

1. Information We Collect

We collect personal data that you submit to us, as well as information from your use of the Platform. This includes contact information, reviews/ratings (if applicable), and technical details. We also collect information from different parts of the Platform, such as usage patterns and device information.

The categories of personal information we collect about you include:

1.1 Information You Provide Directly

Account and Profile Information: Name, email address, phone number, mailing/shipping address, business name (for Merchants), username, country of origin, preferred language, and login credentials when you create an account or register.

Subscription and Transaction Information: For Customers/Members: Subscription preferences, rewards selections, pickup/shipping details, and age verification data (to ensure compliance with legal drinking age requirements). For Merchants: Inventory details, pricing, promotional content, member management data, and ratings/reviews of wines (if shared).

Payment Information: Billing details, such as credit card information, processed securely via third-party payment processors like Stripe (we do not store full payment card details on our systems).

Communication Information: Content from emails, support tickets, feedback, or other interactions with us.

Other User-Provided Data: Any additional information you upload or enter, such as promotional content, transaction records, custom requests, or wine ratings/reviews. When registering or signing in via third-party applications (e.g., social media like Facebook), you authorize us to access certain account information, such as basic profile details (name, profile picture, email, current city). Some information (e.g., password) is never made public; others (e.g., name, profile picture) may be public by default, but you can manage visibility under Profile Settings.

Users are encouraged not to reveal sensitive personal data about themselves or others, such as health information, addictions, or allergies. If you make such information public, you are responsible for its accuracy and warrant that you have legal authority and express permission to disclose it.

1.2 Information Collected Automatically

Usage and Device Information: IP address, browser type, device identifiers, operating system, pages viewed, time spent on the Platform, referral sources, and interactions (e.g., clicks, scrolls, traffic on the Platform).

Location Information: Approximate location based on IP address or geotags (if you choose to add them when reviewing wines; geolocation is not disclosed publicly unless opted in).

Cookies and Tracking Technologies: We use cookies, web beacons, pixel tags, and similar technologies to collect data on your preferences, session management, analytics, and advertising. This includes essential cookies for functionality, performance cookies for analytics, and targeting cookies for personalized content. For more details, see the "Cookies" section below.

Log Data: Server logs capturing access times, errors, and security events.

1.3 Information from Third Parties

Integrations: Data from third-party services like Toast POS (inventory sync), Stripe (payment confirmations), Shippo (shipping details), or other connected tools.

Analytics Providers: Aggregated usage data from tools like Google Analytics.

Public Sources: If applicable, publicly available information to verify accounts or enhance Services.

Social Media and Third-Party Logins: Information from platforms like Facebook (e.g., contacts, profile data) if you connect or share.

We do not collect sensitive personal information (e.g., racial/ethnic origin, health data) unless voluntarily provided and necessary for the Services.

The categories of sources from which your personal information is collected include: directly from you, automatically through your device/usage, from Integrations/third-party providers, and from public sources.

2. How We Use Your Information

We use your information for the following business purposes:

Providing and Improving Services: To manage accounts, process subscriptions and ratings/reviews, facilitate billing and transactions, send automated notifications, provide support, and maintain Platform features like the Business Dashboard and Member Portal. This includes processing your wine ratings to allow other users to view them (with consent) and tracking statistics (e.g., popular wines shared on social media).

Personalization: To tailor content, recommendations, and experiences based on your usage, including developing personalization services, algorithms, and machine learning.

Analytics and Research: To analyze trends, monitor performance, develop new features/updates, and improve offerings (using anonymized or aggregated data where possible).

Marketing and Communications: To send promotional emails, updates, or newsletters (with opt-out options). We may use data for targeted advertising.

Security and Fraud Prevention: To detect, prevent, and respond to security incidents, fraud, or illegal activities.

Compliance and Legal Obligations: To comply with laws, regulations (e.g., alcohol age verification), audits, or legal processes.

Business Operations: For internal purposes like auditing, data analysis, and managing user relations.

Processing is based on your consent, contractual necessity, legitimate interests (e.g., improving the Platform), or legal requirements.

3. How We Share Your Information

Personal data about our users is essential to our business, but we do not sell your Personal Information. We may share it as follows:

Service Providers and Integrations: With third-party vendors that help us operate the Services, such as payment processors (Stripe), POS systems (Toast), shipping carriers (Shippo), cloud hosting providers (e.g., AWS), analytics tools (e.g., Google Analytics), and email services. These parties are bound by contractual obligations to protect your data.

Business Partners: With affiliates or partners for joint offerings, but only with your consent where required.

Other Users: Your reviews/ratings may be shared with other users if you consent (e.g., public profiles).

Legal and Safety Reasons: If required by law, subpoena, court order, or to protect our rights, property, or safety (or that of users/third parties). This includes reporting to authorities for fraud or illegal activities, or if obligated by law.

Business Transfers: In connection with mergers, acquisitions, reorganizations, or asset sales, where your information may be transferred (we will notify you if possible).

With Your Consent: For any other purpose with your explicit permission.

Anonymized/Aggregated Data: We may share non-personal, de-identified data for research, marketing, or analytics.

The categories of third parties with whom we share your personal information include service providers, Integrations, business partners, legal authorities, and successors in business transfers.

Cookies

A cookie is a small text file stored on your computer, tablet, or mobile device to recognize your device on return visits (e.g., for login, language, font size). Cookies may contain text, numbers, or dates but generally no personal data. They are not programs and cannot contain viruses.

We use cookies to enable the Platform to function, provide a personalized experience, and collect statistical (non-personal) information to improve content. If you do not accept cookies, you may not access all functions.

You can modify your browser to block cookies (instructions at https://www.allaboutcookies.org/manage-cookies/clear-cookies-installed.html), but this may limit functionality.

In addition to our own cookies, we use third-party cookies from social media suppliers (e.g., Google, Facebook, Alexa, Pinterest) to enhance functionality, such as sharing to social media and analytics.

Transfer of Data to Third Parties in Other Countries

We may use suppliers located outside the United States to process data on our behalf, in accordance with standard data protection clauses or equivalent safeguards to ensure adequate protection.

4. Data Security

User accounts, including personal data, are protected by passwords. You should choose strong passwords, protect them, and sign off after use. When using third-party logins (e.g., Facebook), passwords are managed by those providers.

We implement reasonable safeguards, but unauthorized entry, hardware/software failures, or other factors may compromise security. We cannot guarantee absolute security.

5. Your Privacy Rights and Choices

As provided by applicable laws (e.g., GDPR, CCPA), you have the right to:

  • Access personal data about you (free copy; additional copies may incur administrative fees if unfounded/excessive).
  • Rectify incorrect/incomplete data.
  • Erase data (under certain circumstances, e.g., no longer needed).
  • Restrict processing (under certain circumstances).
  • Object to processing for marketing (withdraw consent anytime).
  • Data portability.
  • Non-discrimination for exercising rights.

You can access/update much of your data via your account. To exercise rights, contact us at angela@wineview.com. We may verify your identity for security. We respond within required timeframes (e.g., 30-45 days).

Withdraw consent by deleting your profile/account in settings. For marketing opt-out, use unsubscribe links.

You have the right to complain to supervisory authorities (e.g., https://www.usa.gov/privacy or local data protection authority).

6. Children's Privacy

The Platform is for adults of legal drinking age in your jurisdiction. We do not knowingly collect data from individuals under 21 (or legal drinking age). If we discover such data, we delete it promptly. For children under 13 (COPPA compliance), we delete any collected data immediately.

7. International Data Transfers

Data is hosted in the United States. For users outside the US, data transfers comply with safeguards like Standard Contractual Clauses. By using the Services, you consent to such transfers.

8. Data Retention and Account Deletion

We retain data as long as your account is active, or as needed for Services, legal obligations (e.g., 7 years for records), disputes, or agreements.

You can update/delete information via your account. Upon account deletion, we remove attached data (e.g., username from reviews, anonymizing them). Some data may remain in backups temporarily until updated.

We maintain unrevised copies in backups for a period, but delete/anonymize when no longer needed.

9. Third-Party Links and Integrations

Links to third-party sites or Integrations are governed by their policies. We are not responsible; review them.
